Tina Kotek on Tuesday signed a bill giving nurse practitioners and physician associates the same treatment authority in the workers compensation system as physicians and surgeons. H.B. 4040 expands the definition of “attending physician” to include nurse practitioners and physician associates. Attending physicians provide direct care and create treatment plans for injured workers. They also determine whether a person is too injured to work and authorize time off, determine the date that a worker reaches maximum medical improvement, define functional limitations and release injured workers to light- or full-duty status. Attending physicians can also refer injured workers to specialists for additional diagnosis or care and sign off on ancillary services such as physical therapy. Legislation enacted in 2023 allows physician associates to treat injured workers and authorize temporary disability benefits for up to 180 days, creating parity with nurse practitioners who have had the same authority since 2013.
