Raids by immigration authorities and subsequent protests have raised risk management concerns. Risk Management Mar 10, 2026 Public entities such as cities and schools, along with farms, factories, hospitals and other businesses, face a heightened risk environment amid sustained immigration enforcement activity under the Trump administration, experts say. Federal immigration raids in Minneapolis in January and subsequent protests and demonstrations in several U.S. cities underscore the need for organizations to review their business continuity plans, they say. “The risk environment is heightened for everyone, especially because of community pushback against ICE enforcement actions,” said Tamika Puckett, Atlanta-based public entity leader at Protecdiv, a Philadelphia-based minority-owned brokerage, and former municipal risk manager. Claims related to civil commotion and social unrest are rising, she said. “We’re starting to see more claims come in.” Property damage claims are more common than liability claims, she said. Many policies exclude losses related to government actions and some have various immunity protections for law enforcement, Ms. Puckett said. Cyber liability and data privacy coverage could come into play, she said. Some databases contain personally identifiable information and protected health information that federal immigration officers can legally access, but “the line gets blurred” when ICE accesses data that should not be legally shared, such as through a third-party application provider, Ms. Puckett said. Businesses should ensure their property insurance policies cover potential losses related to civil unrest, riots and looting, including property damage and business interruption, said Jorge Aviles, a shareholder in Anderson Kill’s Washington office. Civil authority coverage may help mitigate business interruption losses caused by government actions, such as restricted access to buildings and road closures resulting from curfews or other orders, he said. Political risk coverage is another avenue for policyholders to consider, Mr. Aviles said. The Los Angeles Unified School District has protocols and procedures for handling ICE on campus, but the situation is evolving and requires constant adaptation, said Melissa Hollingsworth, the district’s deputy chief risk officer. The district is the second-largest public school district in the U.S. with 950 locations. Balancing resources to ensure the safety of students and staff and continuity of operations has been “challenging,” she said. The district’s captive insurance program plays a vital role in financing risk and managing claims, Ms. Hollingsworth said. The captive has handled workers compensation claims related to stress and injuries among teachers responding to situations involving students and some employee reimbursement claims for damage to personal property, she said. The district has a $5 million self-insured retention for general liability and auto liability funded through the captive and plans to increase its excess liability limits by $30 million to $50 million ahead of its July 1 renewal, she said. The tower would provide capacity across various lines, including auto liability and sexual abuse and molestation, she said. “The captive program has been crucial in providing resources to handle challenging situations, such as ICE raids and other disruptions,” Ms. Hollingsworth said. Business continuity plans include a virtual learning academy that allows students to attend classes online, she said. Fear of immigration raids has contributed to lower student and staff attendance in some communities. The district also has a mental health hotline available at all times that provides support to students, families and educators, she said. “Whether it’s a natural disaster or ICE raids, a business continuity plan can help you continue operations in light of very difficult circumstances, Ms. Hollingsworth said. “You want to get out in front of it,” said Alan Rothenbuecher, Cleveland-based partner at Benesch, Friedlander, Coplan & Aronoff. ICE enforcement actions can disrupt business operations, resulting in overhead expenses and harming employee morale and confidence, he said. Businesses should ensure that all employees complete I-9 forms, to verify their citizenship and immigration status, and conduct workforce audits to avoid financial penalties and identify unauthorized workers, Mr. Rothenbuecher said. Posting clear signage to mark private areas and designating a trained on-site liaison to handle interactions with ICE is critical, he said. “If your parking lot is private, put a sign there that says nobody unauthorized is allowed to access this area,” he said. Response strategies include understanding the types of warrants ICE can use and ensuring employees know their rights during raids, including the right to remain silent and the right to an attorney, Mr. Rothenbuecher said.
