The committee on Tuesday voted 18-15 to pass H.R. 6213, which would prohibit OSHA from adopting the heat protection standards proposed in the Federal Register in August 2024 or any other rules that are substantially similar. Rules OSHA proposed would require employers to develop an injury and illness prevention plan to control heat hazards. Employers would be required to provide water and rest breaks and develop plans to acclimate new workers to high heat. They would also be required to adopt procedures to respond to symptoms of heat-related illnesses. Rep. Mark Messmer, a Republican from Indiana and the bill’s sponsor, said in a statement that OSHA’s “terrible rule” would create “a one-size-fits-all regulatory approach for most of the American workforce.” State governments already have the authority to establish workplace safety standards, he said. A coalition of lawmakers, public advocacy groups, unions and organizations, including the National Council for Occupational Safety and Health and the American College of Occupational and Environmental Medicine, said in a statement that the bill includes no sunset provision, no mechanism for future reconsideration and no opportunity for action if heat-related injuries continue to increase. “The bill would prevent the establishment of a basic national standard for employers who currently offer no meaningful heat protection,” the statement said. “Workers have no control over extreme heat, and many are unable to refuse hazardous assignments without jeopardizing their livelihoods. Congress should not respond to an escalating occupational hazard by permanently removing the Department of Labor’s authority to address it.” WorkCompCentral is a sister publication of Business Insurance.
