A seasonal favorite is getting a packaging update after a lawsuit over missing faces. The chocolate still has no eyes or mouth. The wrapper, however, has learned to speak lawyer. “Carving not on actual product,” it now warns beside the grinning pumpkin pictured on the signature orange package, Fox Business reported. The change follows Hershey’s successful defense against a proposed class action brought by two Florida consumers who said they bought the candy for its decorative designs and received something less expressive. Nathan Vidal and Eduardo Granados alleged they overpaid for the faceless treats, arguing that the pictured pumpkins’ appeal justified their purchases. Apparently, a peanut butter filling cannot fill every emotional void. A federal judge in Miami dismissed the case, finding the plaintiffs lacked standing to claim they overpaid. Their alleged injury amounted to “subjective disappointment,” she wrote, also noting that the missing carvings did not make the candy defective, worthless, or devoid of economic value.
