S.B. 9813 would amend the state’s workers compensation law to define delivery network companies as the employer of delivery workers who use digital platforms to fulfill orders. The measure defines a delivery network company as an entity that operates in New York exclusively through a digital network connecting customers with workers who deliver goods ordered through the platform. It specifically excludes transportation network companies, such as ride-hailing services, and restaurants that operate their own proprietary ordering systems. The legislation would also expand the definition of “employee” to include delivery network company workers — individuals who have agreements with these companies to pick up and deliver orders for compensation. If enacted, the bill would effectively shift responsibility for workers compensation coverage onto app-based delivery platforms, a move that could have significant implications for gig economy business models operating in the state. The bill has been referred to the Senate Labor Committee and would take effect immediately upon passage.
