In Uber Technologies Inc. et al. v. American Transit Insurance Co ., the U.S. District Court for the Southern District of New York ruled that the New York-based commercial auto liability insurer had wrongly refused to pay for a defense in lawsuits related to accidents involving rideshare drivers. The lawsuits allege that Uber is vicariously liable for the actions of drivers insured under policies issued by American Transit, who were sued in connection with accidents while using the rideshare company’s app. American Transit argued it had no duty to defend because Uber was not an “additional insured” under the policies and was not liable for the conduct of the independent drivers named in the underlying suits. The court ruled, though, that the allegations in the suits that Uber was liable for the drivers’ conduct were enough to trigger the insurer’s duty to defend. “Because the complaints in the underlying lawsuits all allege that Uber is liable for the conduct of the driver, ATIC has a duty to defend Uber,” the court said. American Transit did not immediately respond to a request for comment.
