In E.T. v. The Boys and Girls Club of Hudson County , the state high court affirmed an appellate ruling dismissing the national organization from lawsuits filed by nine plaintiffs who allege they were sexually abused by a part-time counselor at the Boys and Girls Club of Hudson County between 1976 and 1984. The plaintiffs sued after New Jersey amended its Child Sexual Abuse Act in 2019 to revive certain previously time-barred claims. They alleged that counselor Arthur Freudenberg used his position at the Hudson County club to gain their trust before sexually abusing them at club-sponsored activities and at his apartment. In the 1980s, Mr. Freudenberg was charged with 493 counts of aggravated sexual assault involving boys ages 11 to 13 and was sentenced to 20 years in prison, according to the ruling. The Boys and Girls Clubs of America sought dismissal, arguing that New Jersey courts lacked personal jurisdiction over it. BGCA was federally chartered by Congress in the District of Columbia and is headquartered in Georgia, while the Hudson County club is a separate New Jersey nonprofit. The Supreme Court acknowledged that BGCA had contacts with New Jersey. It provided the Hudson County club with sample programs, budgeting and resource-development assistance and professional development and training opportunities, while the local club paid membership dues and used the national organization’s name and logo. But the court said the plaintiffs’ claims did not arise out of or relate to those contacts. Their claims centered on allegations that BGCA failed to implement policies and procedures that could have prevented child sexual abuse, and the court said such a failure did not constitute an affirmative act directed toward New Jersey sufficient to establish specific personal jurisdiction. The court also found that local member organizations had responsibility for hiring, evaluating and training their employees. Writing for the 5-2 majority, one justice said accepting the plaintiffs’ theory could subject BGCA to specific personal jurisdiction in every state whenever an employee or agent of a local club allegedly caused harm that could have been prevented by a national policy or procedure. The dissent argued that BGCA’s promotion, support, branding and requirements for New Jersey clubs were sufficiently related to the plaintiffs’ allegations to permit jurisdiction. The Boys and Girls Club of Hudson County remains a defendant and is subject to New Jersey jurisdiction.
