HB 2490, which passed 203-0, would prohibit counties from requiring child welfare providers to waive insurers’ subrogation rights as a condition of contracting. Such provisions would be “void as against public policy and unenforceable,” the bill states. Child welfare providers continue to struggle to find affordable liability insurance coverage, with premiums rising sharply regardless of whether a provider has a negative claim history, according to a memo from Rep. Aerion Abney, D-Allegheny, the bill’s sponsor. “Many child welfare providers have also been dropped by their insurance policy and are unable to find any coverage at all,” the memo said. Subrogation waivers limit insurers’ ability to recover from counties, increasing insurers’ exposure and contributing to higher premiums and reduced coverage options, the memo said. The legislation would apply to child welfare service contracts entered into or renewed after its effective date. If enacted, it would take effect in 60 days. The bill now moves to the Pennsylvania Senate.
