In American Strategic Insurance Corp. v. Jackson , U.S. District Judge Tiffany M. Cartwright of the Western District of Washington ruled Tuesday that American Strategic Insurance Corp.’s homeowners or personal liability policy does not cover Jacob Jackson for a related civil lawsuit filed by a former player. Mr. Jackson was sentenced to 40 years in prison after a jury found him guilty on 19 counts, including sexual exploitation of a child, rape of a child and child molestation. The insurance coverage dispute arose from a separate civil lawsuit filed in October 2024 by a former player who alleged Mr. Jackson subjected him to sexual harassment and abuse as a player and later as an employee of his youth sports company. St. Petersburg, Florida-based American Strategic had issued the former coach a homeowner’s policy with a $500,000 per-occurrence liability limit and a personal umbrella policy. The company agreed to defend the former coach under a reservation of rights while filing its own action seeking a declaration that no coverage applied. Judge Cartwright found that Mr. Jackson’s alleged conduct did not constitute an “occurrence” — defined in both policies as “an accident” — because acts of sexual abuse are deliberate. Even if the policies were somehow triggered, explicit exclusions for injuries arising out of sexual molestation and for harm “expected or intended” by the insured would independently bar coverage.
