Abigail Spanberger on Monday signed legislation establishing a framework for workplace heat illness prevention standards, creating new compliance considerations for employers and their insurers. S.B. 288 directs the state’s Safety and Health Codes Board to adopt regulations requiring employers to implement heat illness prevention protocols for indoor and outdoor workers. Under the law, employers will be required to provide access to water, shade or climate-controlled environments where practicable, rest breaks, acclimatization measures and employee training. The forthcoming standards also must include temperature-triggered “heat” and “high-heat” procedures and emergency response protocols. The legislation applies broadly to employees and certain contractors working under employer-controlled conditions, though it provides exemptions for emergency response activities and brief exposures of 15 minutes or less. The board has until May 1, 2028, to finalize implementing regulations, which must be developed in consultation with state labor officials and informed by federal and other state standards.
