Qwest and Liberty Mutual Fire Insurance dismissed their claims and counterclaims on Wednesday in a filing with the U.S. District Court for the District of Colorado. No other details were disclosed. The case is Liberty Mutual Fire Insurance Co. v. Qwest Corp. The case stems from the Marshall Fire, reportedly the most destructive wildfire in the state’s history, which destroyed more than 900 homes. Qwest, doing business as CenturyLink, was named as a defendant in three of the roughly 80 consolidated lawsuits over the fire, based on allegations that CenturyLink failed to properly design or maintain its equipment near a trailhead, which was one of the two ignition points of the fire, according to the complaint. Liberty Mutual agreed to defend Qwest while reserving the right to refuse coverage. In 2024, it sued to ask the court to declare it had no duty to defend or indemnify CenturyLink, and allow it to recoup defense costs already paid. Qwest is owned by Lumen Technologies, based in Monroe, Louisiana. Liberty Mutual said Qwest had requested a defense as an “additional insured” under a liability policy Liberty Mutual issued to a company that installed the equipment for Qwest in 2014. Liberty Mutual argued that the agreement that allowed Qwest to be an additional insured had expired. In a responding motion, Qwest argued that Liberty Mutual was not paying its defense costs under its additional insured coverage, but under its supplementary payments coverage. Under that coverage, Qwest’s legal costs were being paid by the equipment installer under the policy’s $1 million deductible. Therefore, there was “not a genuine dispute.” Last September Xcel Energy reached a $640 million settlement with insurers, Boulder County and thousands of residents affected by the fire. A sheriff’s investigation had found that the fire was fed by a spark from Xcel’s power lines at the trailhead. Qwest and Teleport Communications America were also parties to the settlement.
