In a lawsuit filed in federal court in California that’s become a trend hotter than self-help books, the publisher sued OpenAI, Anthropic, Google, Meta, xAI, Perplexity, Apple and Nvidia, alleging hundreds of its copyrighted works were used to train AI models. According to the complaint, the alleged copying may trace back to 2018, when an OpenAI employee downloaded pirated books from Library Genesis to build early datasets. From there, the lawsuit claims, the practice snowballed. An open-source dataset contained roughly 200,000 books, was folded into a larger training set widely used across the industry. Chicken Soup argues the infringement didn’t stop at ingestion. The works were allegedly reproduced multiple times during AI training processes like preprocessing and fine-tuning, turning one act into many. The company also claims its short, emotional, first-person stories made especially attractive training material for models designed to mimic human tone and storytelling. Unlike other AI copyright cases leaning toward classwide settlements, Chicken Soup is seeking individualized damages to be decided by a jury. The complaint criticizes proposed payouts in similar cases — about $3,000 per work — as far below the Copyright Act’s potential damages.
