Feb 9, 2026 A Delaware judge refused to dismiss an insurance coverage lawsuit brought by Syngenta Crop Protection over liabilities tied to the herbicide paraquat. In a Dec. 17 ruling unsealed last week, the Delaware Superior Court ruled in Syngenta Crop Protection LLC v. Travelers Casualty and Surety Co. that the insurers failed to show sufficient hardship to move the case to London or halt the Delaware proceedings. Paraquat is an agricultural herbicide used to control weeds that has allegedly caused serious health problems in humans. Syngenta is the successor to ICI Americas Inc., a former U.S. subsidiary of British chemical group ICI. Syngenta is seeking coverage under primary and excess liability policies issued in the 1970s and 1980s. The insurers argued the dispute should be handled in England, citing a separate London action Syngenta filed in late 2023. Judge Sheldon K. Rennie rejected that argument, noting that the Delaware case was filed in 2021, concerns underlying events that occurred in the United States and has already been the subject of years of litigation and discovery. By contrast, the London case has seen little activity. The court also said transferring the case would likely delay resolution and duplicate work already completed in Delaware. “Syngenta, as the plaintiff in this action, is generally entitled to its choice of forum — choosing to file in Delaware is its prerogative,” the court ruled.
