In Mtiri v. Encompass Health Rehabilitation Hospital of Memphis , the board upheld a finding that the employer had actual notice of the reported accident but ruled that the worker had not shown he was likely to prevail on medical causation. Lofti Mtiri said he missed the bottom step of a ladder while changing a ceiling tile in December 2024 and struck a desk, injuring his low back and left leg. Encompass initially accepted the claim and paid medical and temporary disability benefits before denying it based on notice and causation. The trial court credited Mr. Mtiri’s testimony that he verbally reported the accident to his supervisor within four days and ordered Encompass to resume benefits. The appeals board deferred to the trial court’s credibility finding on notice. It found, however, that the medical evidence did not support an interim award of benefits. The board said the authorized physician’s questionnaire responses were confusing, inconsistent and equivocal on whether the work incident primarily caused Mr. Mtiri’s conditions. By contrast, a spine specialist who examined him clearly concluded that his lumbar condition was degenerative, that neither his back nor thigh complaints were primarily work-related and that no further treatment was necessary. The board reversed the award of additional medical and temporary total disability benefits and remanded the case for further proceedings. Costs of the appeal were assessed against Encompass.
