House passes bill to cover exacerbation of mental health conditions by Work Comp Central Workers Comp Coverage , Workplace Safety Feb 19, 2026 The Virginia House of Delegates unanimously passed a bill that would provide workers compensation coverage for the exacerbation of preexisting mental health conditions without an accompanying physical injury for law enforcement and firefighters. The House on Tuesday voted 97-0 to pass H.B. 1313, which would clarify that coverage for so-called “mental-mental” claims also includes worsening of a preexisting disorder. Legislation enacted in 2020 allowed claims for post-traumatic stress disorder, anxiety disorder or depressive disorder without a physical injury when a firefighter or police officer is diagnosed with the condition as a result of a qualifying event, such as responding to a mass casualty incident or exposure to serious bodily injury or death. H.B. 1313 would repeal a statute requiring the qualifying event and not another event or source of stress to be the primary cause of the claimed condition. The bill now goes to the Senate for additional deliberation.
