H.B. 5428 would add a section to state law directing the Law-Enforcement Professional Standards Subcommittee to establish a program offering up to 12 visits of licensed counseling per qualifying incident. Counseling would be employer-paid and could be in-person or telehealth. Qualifying events include witnessing death or maiming, investigating dangerous crimes against children, being involved in or subjected to deadly force, requiring rescue when one’s life was endangered, witnessing the death of a fellow officer or firefighter and responding to incidents involving the drowning or near drowning of a child. If a licensed mental health professional determines additional treatment is needed and likely to improve the employee’s condition, employers would be required to pay for up to 24 additional visits within one year of the first appointment. Under the bill, employers could not require employees to use accrued vacation, sick or personal leave for covered counseling visits. If a mental health professional determines an employee is unfit for duty, the employer would be required to provide up to 30 days of pay and benefits per incident under certain conditions. The legislation also would require annual data collection and reporting on program participation, missed work and related workers compensation claims.
