Wayne Gandy, who played 15 NFL seasons before retiring in February 2009, filed a California workers compensation claim in September 2015 alleging cumulative injuries to multiple body parts. He named several former teams, including the Atlanta Falcons, in the claim addressed in Atlanta Falcons v. Workers’ Compensation Appeals Board , decided by the California Court of Appeal, Fourth Appellate District, Division Three. Mr. Gandy signed a contract in California with the Los Angeles Rams in 1994 and continued under that contract after the team moved to St. Louis. He later played for Pittsburgh, New Orleans and Atlanta. The compensation appeals board concluded that his California hiring gave it jurisdiction regardless of statutory exemptions for professional athletes. The appeals court rejected that interpretation. The Falcons provided workers compensation coverage under another state’s laws that also covered Mr. Gandy’s work in California. He performed fewer than 20% of his duty days in California during the relevant period, satisfying an exemption for athletes temporarily working in the state. The court also found that his career did not satisfy the conditions for avoiding a separate exemption: He played only one season for a California-based team, spent fewer than 20% of his career duty days in California or with a California-based team, and played at least seven seasons for non-California teams. The court annulled the board’s decision and remanded the matter. Its ruling addressed only the Falcons’ liability, not that of Mr. Gandy’s other former teams.
