According to State ex rel. In Southwest Community Health System v. Industrial Commission of Ohio , the Ohio Court of Appeals for the 10th District denied the employer’s request for a writ of mandamus after concluding that the physicians’ reports contained objective findings and that the commission’s decision was supported by some evidence. Elizabeth Edwards suffered a work-related concussion, cervical strain and post-concussion syndrome after an October 2021 workplace injury. Although she later reached maximum medical improvement, physicians concluded she remained unable to perform sustained remunerative employment because of persistent vision problems, balance impairment and cognitive deficits. Southwest Community Health System argued the commission improperly relied on physicians’ reports that merely repeated Ms. Edwards’ subjective complaints without objective findings, as required under Ohio administrative rules. The appeals court rejected that argument, finding the reports documented objective medical findings, including cervical tenderness, trapezius muscle spasms, loss of cervical lordosis, impaired balance, a wide-based gait, diminished eye mobility and deficits in attention and concentration. The court also rejected the employer’s contention that the commission misapplied Ohio’s “some evidence” standard, emphasizing that reviewing courts may not reweigh evidence relied upon by the Industrial Commission so long as the record contains evidence supporting its decision.
