Osmair Sebastio De Souza was removing plywood sheets from a ceiling while standing on an eight-foot A-frame ladder when a piece struck the ladder, causing it to move, according to De Souza v. 4720 Third Ave LLC , filed in the New York Supreme Court, Appellate Division, First Department. New York’s scaffold law requires covered owners and contractors to provide adequate protection against elevation-related hazards. Such lawsuits against responsible third parties can proceed alongside workers compensation claims, with comp insurers generally entitled to seek reimbursement from a recovery. Mr. De Souza testified that he stood on the ladder’s sixth step, while a coworker placed him on the second. The court found that disagreement immaterial because even a two-foot fall can involve a hazard covered by the law. The court also rejected defendants’ argument that Mr. De Souza was solely responsible. He followed his employer’s instructions, and any negligence on his part could not be the sole cause when a statutory violation also contributed to the accident. Defendants remained obligated to secure the plywood against falling, even though removing it was the purpose of the work, the court said.
