The case, Craig Chiaccheri v. Zurich American Insurance Company , came to the New Jersey Supreme Court on two questions certified by the U.S. Court of Appeals for the Third Circuit. Craig Chiaccheri was injured in 2022 while driving a vehicle owned by his employer, Framingham, Massachusetts-based TJX Companies, insured under a Zurich American policy with a $2 million bodily injury liability limit but only $15,000 in underinsured motorist coverage. Because the at-fault driver’s $100,000 policy exceeded that uninsured motorist limit, Zurich denied Mr. Chiaccheri’s uninsured motorist claim. He sued, arguing state law entitled him to uninsured motorist coverage matching the policy’s full liability limit. Justice Anne M. Patterson, writing for a unanimous court, held that New Jersey’s underinsured motorist statute requires only that employees receive uninsured motorist coverage equal to the employer’s limit for the named policyholder, not coverage matching the policy’s third-party liability limit. “The Legislature could have required insurers to offer — and commercial policyholders to purchase — UIM coverage at limits equal to their third-party policy limits for personal injury and property damage,” the judge wrote. “It did not do so.” The court also held that endorsements capping uninsured motorist coverage below the general liability limit don’t violate the statute so long as the coverage meets statutory minimums and applies equally to the named policyholder and employees alike. Judge Patterson noted lawmakers passed the provision to override a 2005 state Supreme Court ruling that had allowed insurers to reduce uninsured motorist coverage for employees to the level of their personal policies.
