Jeff Landry a bill that would expand disciplinary procedures and sick-leave protections following assaults and batteries involving students and school employees. H.B. 283 would allow school employees to use sick leave for medical treatment, psychological treatment and physical rehabilitation after being injured in an assault or battery by a student. It unanimously passed both chambers. It would also require schools to annually notify teachers and school employees, including bus operators, of their rights to take or request disciplinary action against students who violate school rules or interfere with the education process. Principals and administrators would be barred from discouraging such actions or retaliating against employees who pursue disciplinary measures under school policy. Under the bill, a student formally accused of assaulting or battering a school employee would have to be immediately suspended and removed from school premises, with required notifications and procedures to follow as soon as practicable. The provision would apply to off-campus incidents only if they are a continuation of a documented altercation that began on school property. The measure also states that negligent hiring statutes or rules would not apply in disputes involving schools that hired certain employees, including teachers, substitute teachers, administrators, athletic directors and coaches, if the employee held a valid state teaching certificate or authorization.
